ARBITRATION NOTICE: Except for certain kinds of disputes described in Section 21, you agree that disputes arising under these Terms will be resolved by binding, individual arbitration, and BY ACCEPTING THESE TERMS, YOU AND JAMAJI LLC (FARMABOT) ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.

1. Agreement to Terms

FarmaBot is a service operated by Jamaji LLC (“FarmaBot”, “we”, “us”, or “our”). These terms and conditions, together with our Privacy Policy at https://www.farmabot.com/privacy (these “Terms of Service” or “Terms”), govern your access to and use of farmabot.com (our “Website”), our mobile applications for Apple, Google, and Huawei platforms, our APIs, and any software, content, functionality, and services (collectively, the “Services”) offered by FarmaBot.

Please read these Terms carefully before you start to use or access our Services. By creating an account, downloading the app, or using our Services, you accept and agree to be bound by these Terms. If you are not eligible or do not agree, you must not access or use the Services.

2. Eligibility

The Services are intended for adults. By accessing or using the Services, you represent and warrant that you are at least eighteen (18) years old (or the age of majority in your jurisdiction, if higher), that you possess the legal right and ability to enter into these Terms, and that you will use the Services in accordance with these Terms.

3. Description of Services

FarmaBot provides tools to help you organize medicines and related routines, including:

• Household medicine inventory and expiry tracking
• Reminders and dose logging that you schedule and control
• Health history, appointments, and related organization features
• Optional sharing with caregivers you choose
• Optional AI features (e.g. photo extraction, general informational assistant)
• Optional nearby pharmacy search, pets, and notification channels depending on your plan and device permissions

Feature availability may vary by platform (iOS, Android, Huawei), plan, and region.

4. Medical disclaimer (important)

• FarmaBot is not a medical device and does not provide medical advice. It does not diagnose, prescribe, recommend treatments, or calculate or suggest doses.
• Information in the app, catalog, and AI assistant is general and informational, may contain errors or omissions, and does not replace a doctor, pharmacist, or other healthcare professional. Always consult a healthcare professional before taking, changing, or stopping any medicine.
• Symptom search only filters the inventory you registered; it never recommends taking a medicine or states a dose.
• In an emergency, contact local emergency services immediately. FarmaBot is not designed for emergencies or clinical monitoring.
• You are responsible for reading medicine labels and following your healthcare professional’s instructions.

5. Reminders are not guaranteed (important)

FarmaBot helps you remember doses, but does not guarantee delivery or timing of any notification (push, SMS, WhatsApp, email, or call). Delivery depends on your device, operating system, connectivity, permissions, battery settings, store/push infrastructure, carriers, and other third parties outside our control.

FarmaBot is not a safety or clinical monitoring system. Do not rely solely on FarmaBot for critical doses; responsibility for taking your medicines remains yours.

6. AI features

Photo extraction and assistant responses may be inaccurate or incomplete. You must review and confirm AI-proposed data before saving it, and must not treat assistant responses as professional advice, diagnosis, or dosing guidance.

7. Account responsibilities

When you create an account, you agree to:

• Provide accurate and complete information and keep your contact email up to date
• Maintain the security and confidentiality of your credentials, PIN, and device access (including biometrics on your device)
• Accept responsibility for all activity under your account
• Promptly notify us of any unauthorized use of your account
• Not share your account in a way that violates these Terms or applicable law

You are solely responsible for losses incurred because someone else used your account due to your failure to keep it secure.

One device at a time. Your account is signed in on a single device. When you sign in on another device, we warn you first and then close the session on the previous one; your data is uploaded before that device is cleared. This keeps a single dose reminder from ringing on two phones and keeps two people from recording conflicting information about the same dose. If you need FarmaBot for more than one person, use the sharing feature or a family plan rather than sharing one account.

8. Sharing with caregivers

If you share information with another person, you authorize that person to access the data you choose and, if enabled, to receive related notifications. You are responsible for whom you share with and what you share. You may revoke access at any time. Women’s health data (cycle/contraceptives) is not shared through this feature.

9. Prohibited uses

You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable law or regulation
• Infringe intellectual property or other rights of third parties
• Attempt to gain unauthorized access to our systems, servers, or other users’ data
• Interfere with the security, integrity, or availability of the Services (including denial-of-service attacks)
• Use the AI assistant to obtain harmful or illegal instructions or to bypass safety restrictions
• Abuse messaging channels, rate limits, or usage quotas
• Impersonate FarmaBot, Jamaji LLC, another user, or any other person or entity
• Sell, transfer, or resell access granted under these Terms without our permission
• Upload malware or content designed to harm systems

10. Subscriptions and payments (app stores)

The Services may include free and paid subscription plans (for example Free, Essentials, Premium, Premium+/Plus, and family options), as described in the app and on farmabot.com. The essential local alarm and reminders are free and are not placed behind a paywall.

Where you purchase matters. Depending on how you buy, payment is processed by:

• Apple App Store (iOS / iPadOS) — subject to Apple’s terms, billing, and refund rules
• Google Play (Android) — subject to Google’s terms, billing, and refund rules
• Huawei AppGallery (Huawei devices) — subject to Huawei’s terms, billing, and refund rules
• Web / Stripe (if we offer web checkout) — billed by us or our processor under the checkout terms shown at purchase

By purchasing a Subscription, you agree that it will automatically renew and you will be charged until you cancel, unless the applicable store or checkout flow states otherwise. You must cancel before renewal to avoid the next billing cycle. Cancel through the same store or channel where you subscribed (Apple subscriptions settings, Google Play subscriptions, AppGallery subscriptions, or the web billing portal, as applicable).

• Prices are shown in the store or checkout in the applicable currency unless otherwise stated
• We do not store your full card number; card data is handled by the store or payment processor
• Refunds, chargebacks, grace periods, and tax handling are governed primarily by the policies of the store or processor you used
• We may change pricing with reasonable advance notice when required by law or store policy; continued use after the effective date may mean acceptance of the new price for the next period
• Some channels (SMS, WhatsApp, calls) or AI features may have plan-based usage limits shown in the app
• If you change devices or reinstall, use Restore purchases in the app and sign in with the same FarmaBot account
• Failed payments may result in loss of paid features until payment succeeds or the store restores entitlement

11. Free plan

The Free plan is provided at no cost with the features described in the app. We may modify Free plan limits or discontinue optional free features with reasonable notice, but we will not put the essential local alarm/reminders behind a paywall. Free plan accounts have no uptime guarantee beyond commercially reasonable efforts.

12. Intellectual property

The Services and their contents, features, and functionality (including the Website, apps, software, text, displays, images, mascot, and design) are owned by Jamaji LLC, its licensors, or other providers and are protected by United States and international intellectual property laws.

You retain ownership of the data and content you enter (“User Content”). You grant us a limited, non-exclusive, non-transferable license to host, process, transmit, and display User Content solely as necessary to provide the Services (including sharing features you enable and AI features you request).

FarmaBot, its logo, and associated branding are trademarks of Jamaji LLC. You may not use our trademarks without prior written consent. If you provide feedback or suggestions, you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use that feedback to improve the Services.

13. User Content

User Content includes medicines, schedules, health notes, photos, caregiver shares, and similar information you submit. You represent that you have the right to provide User Content and that it does not violate law or third-party rights. We treat health-related User Content as sensitive and handle it as described in our Privacy Policy. We are not obligated to back up User Content beyond what is needed to operate the Service; you should keep your own records for critical medical information. On free accounts, the cloud backup restores the last 12 months of daily records — doses, measurements, hydration and similar — while paid plans restore your full history; your device keeps your own copy on either plan. The exact periods are in the Privacy Policy.

14. Account suspension and termination

These Terms are effective when you accept them or first use the Service, and continue until terminated. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service (with reasonable notice when practicable). Any material violation may result in suspension or termination without refund of store-billed amounts already paid (store refund rules may still apply).

You may terminate at any time by deleting your Account in the app or contacting support@farmabot.com and discontinuing use. Upon termination: (a) your license ends; (b) you must stop using the Service; (c) unpaid amounts remain due if any; and (d) provisions on intellectual property, medical disclaimers, warranties, liability, indemnity, arbitration, and governing law survive.

15. Third-party services

The Services integrate or rely on third parties, including Apple, Google, Huawei (app distribution, push, sign-in, and in-app purchases), payment processors (e.g. Stripe), AI providers, messaging providers, maps/places providers, and cloud infrastructure. By using the Services, you acknowledge that we are not responsible for examining or evaluating those third parties’ content, availability, or practices. Third-party materials and purchases are subject to their own terms and policies.

16. Disclaimer of warranties

WE PROVIDE THE SERVICES “AS IS” AND “AS AVAILABLE,” WITHOUT ANY REPRESENTATION OR WARRANTY, EXPRESS, IMPLIED, OR STATUTORY. WE SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT NOTIFICATIONS WILL ALWAYS BE DELIVERED ON TIME. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

17. Service availability

We strive to keep the Services available and will use commercially reasonable efforts to provide notice of material planned downtime when practicable. We may modify or discontinue all or any portion of the Service at any time. To the maximum extent permitted by law, we will have no liability for changes, suspensions, or terminations of access, or for store/push/carrier outages outside our control.

18. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL JAMAJI LLC (FARMABOT) BE LIABLE, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), OR OTHER THEORY, FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, OR DAMAGES ARISING FROM MISSED DOSES, HEALTH DECISIONS, UNDELIVERED OR LATE NOTIFICATIONS, AI OR CATALOG INACCURACY, OR THIRD-PARTY ACTS (INCLUDING APP STORES AND CARRIERS).

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE GREATER OF (a) THE AMOUNT YOU HAVE PAID US FOR THE SERVICES IN THE LAST TWELVE (12) MONTHS, OR (b) ONE HUNDRED U.S. DOLLARS (USD $100). Nothing in these Terms limits liability that cannot be excluded by law (for example willful misconduct or gross negligence, or non-waivable consumer rights).

YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER IT ACCRUES, OTHERWISE IT IS PERMANENTLY BARRED, TO THE EXTENT PERMITTED BY LAW.

19. Indemnification

You agree to indemnify and hold Jamaji LLC, its affiliates, and their officers, directors, employees, and agents harmless, including reasonable legal fees, from any claim or demand by a third party arising out of: (a) your access to or use of the Services; (b) your violation of these Terms; (c) infringement of any right of any person or entity; or (d) User Content you submit, to the extent permitted by law.

20. Force majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, acts of government, internet or power outages, cyberattacks, pandemics, labor disputes, or failures of third-party providers (including Apple, Google, Huawei, carriers, and cloud vendors).

21. Dispute resolution and arbitration

Except as described in the exceptions below, you and FarmaBot agree that every dispute arising in connection with these Terms or the Services will be resolved through binding arbitration. Arbitration uses a neutral arbitrator instead of a judge or jury, is less formal than a court proceeding, and is subject to very limited review by courts.

YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND JAMAJI LLC (FARMABOT) ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

Exceptions: Nothing in these Terms waives the right of either party to: (a) bring an individual action in small claims court; (b) pursue an enforcement action through an applicable agency if available; (c) seek injunctive relief in a court of law in aid of arbitration; or (d) file suit solely to address an intellectual property infringement claim.

Opt-out: If you do not wish to resolve disputes by binding arbitration, you may opt out within 30 days after first accepting these Terms by emailing privacy@farmabot.com with subject “Arbitration Opt-Out”, your full legal name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration.

No class actions: YOU AND JAMAJI LLC (FARMABOT) AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

If arbitration is found unenforceable as to you, or if you validly opt out, disputes will be resolved in the courts described in Section 22, without prejudice to mandatory consumer forum rights in your country of residence.

22. Governing law

These Terms and any claim arising out of them will be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, and without prejudice to mandatory consumer rights in your country of residence. Subject to Section 21, state or federal courts located in Wyoming will have jurisdiction, unless mandatory law requires another forum.

23. Consent to electronic records

You consent to receive contracts, notices, and communications from us electronically (including in-app and by email) instead of on paper, to the extent permitted by law.

24. International access

Our infrastructure and many subprocessors operate in the United States and other countries. If you access the Services from another country, you may be transferring information to those locations as described in our Privacy Policy. You agree to comply with local laws applicable to your use of the Services.

25. Severability and entire agreement

If any provision is found unenforceable, it shall be limited or eliminated to the minimum extent necessary, and the remaining provisions remain in full force. No waiver shall be deemed a continuing waiver. These Terms, together with our Privacy Policy and the applicable app-store or payment-processor terms for your purchases, constitute the entire agreement between you and us regarding the Services and supersede prior agreements on the same subject.

26. Assignability

You may not assign these Terms without our prior written consent. We may assign these Terms without your consent in connection with a merger, acquisition, corporate reorganization, or sale of assets. Any attempted assignment in violation of this section is void.

27. Changes to Terms

We may revise these Terms from time to time. For material changes, we will provide reasonable advance notice (for example via email or a prominent in-app or website notice) when practicable. We will update the “Last updated” date. Continued use after the effective date constitutes acceptance of the updated Terms. If you disagree, you must stop using the Service and may delete your account.
